CONTENT MODEL SESSION PARTICIPATION AND FILMING AGREEMENT

Complimentary Massage in Return for Participating in Promotional Content

2. Purpose of the session


The Participant understands that this is a promotional content-model session and not a standard complimentary massage appointment.


Healing Point will provide the Participant with the massage treatment described above in return for the Participant’s time and agreed participation in professional photography and video filming.


The purpose of the session is to create promotional and advertising content for Healing Point – Glasgow.


The Participant understands that filming is an essential part of this appointment and that the appointment may take longer than the massage treatment because time may be required for preparation, lighting, camera setup and recording different angles.


3. Age and ability to participate


The Participant confirms that they are aged 18 or over and are able to enter into this agreement.


No previous acting or modelling experience is required.


The Participant agrees to follow reasonable instructions from the therapist, photographer, videographer and Healing Point representative during the session.


4. Treatment and health information


Before receiving the massage, the Participant must complete Healing Point’s standard health consultation form honestly and accurately.


The Participant agrees to disclose any medical condition, injury, allergy, medication, pregnancy, recent surgery or other information that may affect their suitability for massage.


The therapist may adapt, shorten, stop or refuse the treatment where they reasonably believe it may be unsafe or unsuitable.


The Participant’s health and safety will take priority over the filming plan.


The Participant’s private health consultation and medical information will not be intentionally recorded or used in advertising without separate and explicit agreement.


5. Filming activities


The filming session may include:

  • Arrival and exterior footage

  • Reception and greeting scenes

  • Meeting the therapist

  • Entering or preparing the treatment room

  • Preparing for the treatment

  • Agreed parts of the massage

  • Close-up views of massage techniques

  • Relaxation and wellness scenes

  • Photographs during or after the treatment

  • Leaving the premises

  • A short interview or testimonial, where agreed

  • Natural or staged scenes created for Healing Point’s advertising


The Participant may be asked to repeat a natural action or movement so it can be recorded from another angle.


The planned filming may include the Participant’s face, body, voice or first name where this has been explained and agreed before filming begins.


Any specific restrictions agreed with the Participant:


6. Dignity, privacy and comfort


Healing Point will conduct the session professionally and take reasonable steps to protect the Participant’s dignity and comfort.


Appropriate towels and professional draping will be used during the treatment. Private or intimate areas will not be exposed or filmed.


Only body areas reasonably required for the agreed promotional content will be recorded.


The Participant may ask for filming to pause and may refuse a particular position, angle or activity if they feel unsafe or unexpectedly uncomfortable.


The Participant should immediately tell the therapist or filming team if they experience pain, illness, anxiety or discomfort.


Because filming is the main purpose of this appointment, Healing Point may change or end the session if the agreed promotional content can no longer reasonably be created.


No sexual, erotic or inappropriate conduct is permitted during the session.


7. Permission to record and use the content


The Participant gives Healing Point permission to photograph, film and, where agreed, audio-record them during the Content Model Session.


Subject to the restrictions recorded in this agreement, Healing Point may use the resulting photographs, video footage, audio and edited content for the promotion of Healing Point – Glasgow, including:


  • Healing Point’s website

  • Instagram, Facebook, TikTok and YouTube

  • Google Business Profile

  • Online booking platforms

  • Organic social-media posts

  • Paid social-media and digital advertising

  • Email marketing

  • Promotional videos

  • Posters, leaflets and brochures

  • In-premises displays

  • Recruitment and business presentations

  • Public-relations and media materials


Online content may be accessible worldwide, even where the campaign is primarily intended for audiences in the United Kingdom.

8. Usage period


Healing Point may use the content for the following agreed period:

Any continued use after the agreed ending date must be reviewed and, where necessary, agreed again in writing.


Content that has already been lawfully printed, distributed, shared or downloaded may continue to exist after the usage period ends.

9. Editing and presentation


Healing Point may reasonably edit the content, including by:

  • Cropping or resizing images

  • Shortening video footage

  • Adjusting lighting, colour, sound or image quality

  • Adding subtitles, captions, text, graphics or logos

  • Adding suitable music or voiceover

  • Combining the content with other footage

  • Creating different versions and sizes for different platforms

  • Extracting still photographs from video footage


Healing Point will not intentionally edit or use the content in a defamatory, degrading, sexually suggestive or materially misleading way.


Healing Point will have reasonable editorial control over the finished content unless a different arrangement is written below.


Any agreed preview or approval arrangements:

If nothing is written above, the Participant understands that they will not approve every final version before publication.


10. Interview or testimonial


The Participant may be invited to give a short interview or testimonial after the massage.


Any testimonial must reflect the Participant’s genuine experience and opinion. The Participant will not be required to make a statement they do not believe to be true.


Healing Point may edit a testimonial for length or clarity but will not intentionally change its overall meaning.


The Participant must not claim that the massage diagnosed, treated or cured a medical condition.


Where the Participant received a complimentary treatment in return for filming, Healing Point may disclose that arrangement alongside relevant promotional content.


Healing Point must keep evidence showing that a testimonial is genuine and accurately reflects what the participant said.


11. Compensation


In consideration for the Participant’s time, appearance and agreed participation, Healing Point will provide:

The complimentary massage is the complete compensation for the Participant’s participation.


The massage:

  • Has no cash value

  • Cannot be transferred to another person

  • Cannot be exchanged for money

  • Cannot be replaced with a gift voucher

  • Cannot be converted into account credit

  • Does not create a right to royalties or future payments


12. Copyright and ownership


The Participant understands that copyright in the photographs, videos and final promotional materials may belong to Healing Point, the photographer, the videographer or another authorised content creator, depending on the relevant production arrangements.


The Participant does not automatically own the raw footage or finished advertising materials and will not automatically receive copies unless separately agreed.


Healing Point will ensure that it has the rights or licences reasonably required to edit and use the content for the purposes described in this agreement.


13. Privacy and personal information


The Participant understands that identifiable photographs, videos and voice recordings are personal information.


Healing Point will process the Participant’s information in accordance with its Content Filming Privacy Notice and applicable data-protection law.


The content may be accessed or processed where reasonably necessary by:

  • Healing Point management and authorised staff

  • The photographer or videographer

  • Video and photograph editors

  • Marketing service providers

  • Website and cloud-storage providers

  • Social-media and advertising platforms


The Participant understands that publicly available content may be viewed, copied, downloaded, recorded or shared by other people outside Healing Point’s control.


The Participant confirms that they have received, or have been given access to, Healing Point’s Content Filming Privacy Notice before signing this agreement.


14. Changing your mind and withdrawal


The Participant may cancel their participation before filming begins.

After filming, the Participant may contact Healing Point to raise a concern or request that a particular use of identifiable content stops.


Where Healing Point relies on the Participant’s consent for a specific use, the Participant may withdraw that consent. Withdrawal will not affect the lawfulness of use that took place before the withdrawal.


Healing Point will consider and respond to withdrawal, deletion or objection requests in accordance with the lawful basis being used and applicable data-protection law.


The Participant understands that Healing Point may not be able to:

  • Recall printed materials that have already been distributed

  • Remove screenshots or copies downloaded by members of the public

  • Control content independently shared by another person

  • Remove content from third-party websites or accounts outside Healing Point’s control

  • Recover materials already supplied to an external publisher

  • Remove the Participant from group footage without removing the complete work

15. Cancellation and non-attendance


The Participant agrees to give Healing Point at least 48 hours’ notice when cancelling or rearranging a confirmed session.


Repeated cancellations, cancellation at short notice or failure to attend may result in the Participant not being considered for future Content Model Sessions.


Healing Point may cancel or rearrange the session because of therapist or filming-team unavailability, equipment failure, health and safety concerns, changes to the campaign, premises issues or other unexpected operational circumstances.


Where Healing Point cancels before the session takes place, the Participant will not normally receive cash compensation, a gift voucher or an unrelated complimentary massage. Healing Point may offer another filming date at its discretion.


16. Ending the session


Healing Point may immediately stop the treatment or filming if:

  • The Participant behaves abusively, sexually or inappropriately

  • A health or safety concern arises

  • The Participant has provided materially inaccurate health information

  • The therapist believes the treatment should not continue

  • The Participant cannot or will not participate in the previously agreed filming

  • Continuing would place the Participant, staff or another person at risk

Stopping the session will not affect any rights that either party has under applicable law.


17. Liability and statutory rights


Healing Point will provide the massage treatment with reasonable care and skill.


Nothing in this agreement excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be excluded.


Nothing in this agreement affects the Participant’s statutory rights.


18. Governing law


This agreement is governed by the laws of Scotland.


Any dispute will be subject to the jurisdiction of the Scottish courts, except where applicable law gives the Participant the right to bring proceedings elsewhere.


ACCEPTANCE AND SIGNATURES


By signing below, the Participant confirms that:

  • They are aged 18 or over

  • They have read and understood this agreement

  • They have had the opportunity to ask questions

  • The filming plan and intended use of the content have been explained

  • They understand that this is a promotional filming appointment

  • They understand that the complimentary massage is provided in return for their agreed participation

  • They agree to the recording and use of their appearance as described in this agreement

  • They have disclosed any agreed restrictions before signing

  • They have received or been given access to the Content Filming Privacy Notice

  • They understand how to contact Healing Point about the footage or their personal information

  • They enter into this agreement voluntarily

  • They understand that this agreement does not remove their statutory or data-protection rights
